  TERMS AND CONDITION

(1)   Our company is Full Time Broking Company or Real Estate Agents Company .We are stock of property Information for buying / selling / Leasing etc. and it is our stock in trade and we are render our service to That client who engage us for rendering service of REAL ESTATE CONSULTANCY or Estate Agent on  Fixed remuneration / Commission. The commission / Brokerage is fixed By the Estate Agents Association Of India.

(2)   We are registered with The Estate Agents of India, Profession Tax No. Allotted , Income Tax PAN allotted Shop & establishment Licence Profession Tax Registration No Allotted  ,  Service Tax Reg. Code allotted  ,  we are also registered with many institutions and trusts. Our Bankers are ( Add Name of Bank ) ,

(3)   We will charge late payment charges on delayed of payments of or Brokerage, Commission, Fees, Expenses, etc., as applicable (@ 2% P.M.)

(4)   Other terms and conditions will be as per the Customer Agreement or form signed   by the client  or the authorized signatory , as the case may be.

(5)   Our certificate of registration under Section 69 of the finance Act, 1994 (32 of 1994) I/We having undertaken to comply with the conditions prescribed in the Service Tax Rules, 1994, in addition, any order issued there under is hereby Certified to have been registered with the Central Excise Department of Service Tax on service of “Real Estate Agent”. Our Registration No. REA/Mumbai-allotted and Assesses Code No. duly allotted 

(6)   Service Tax applicable as per the rules and regulation , that is @ 12.24 % Inclusive  S.C. 2 % of  total Service Tax w.e.f. as per finance bill July. 2006.

(7)   All the Rates & Charges are followed as per or terms and condition and as per the “SCHEDULE OF RATES OF COMMISSION” which is strictly enforced  by the “THE ESTATE AGENT ASSOCIATION OF INDIA” Regd. Address Gundecha Chamber, 3rd floor, Nagindas Master Road, Fort, Mumbai-400 023.

(8)   Commission/Brokerage/Agency Fee/Service Charges/Terminal Charges under     any name paid to us for service rendered shall not be refundable under any circumstances.

(9)   25 % total Brokerage and Service Charges Payable at the time of payment of earnest money, by way of non-refundable service charge and out of pocket expenses and balance 75% at the time of receipt of allotment letter or on signing of agreement or on possession or on receipt / payment of full & final payment and or peaceful Vacant possession WHICHEVER IS EARLIER.

(10) Subject to Bombay jurisdiction.

(11) T.D.S. applicable @ 5.61 % inclusive Surcharge to T.D.S. (2% of total T.D.S.)

(12) Our registered address is : ( Brokers Address )

(13) If letter faxed to you then it will as good as registered letter or receipt of the Said letter is treated as original one Hard copy will be send on written request.

(14) We recommend you not to approach or negotiate for any things with our client Directly without knowing or informing us and if you do so then that is on your Risk and liability only.

(15) Document supplied by our client to you or through us or by our client’s attorney   Then you having full responsibility to keep these documents and all the matter Secrete and confidential.

(16) At any case we are not responsible for any loses due to our client mistake and If any litigation take place in future amongst or between parties then parties Should pay our all expenses fees, charges, Brokerage, losses etc., with interest @ 18 % p.a. if payment of brokerage delayed for any reason.

(17) As you know that our firm is Estate Agents / Broking firm and not involve with any legal Aspect / matter etc. at any time. Hence, you may contact your lawyer and architect For any legality our suggestion and opinion in any manner is not consider if any legal Matter takes place.

(18) Your co-operation is only make us success and it help us to compete your deal within stipulated time
